Starting from September 1st, 2023, new rules will be implemented to provide better protection to individuals facing payment delays. Entrepreneurs will need to comply with these stricter rules regarding interest and indemnities charged to individual clients.
The first payment reminder will be free of charge for the client, who will then have 14 days to make the payment without incurring any additional fees.
Entrepreneurs will be required to limit the indemnity clause based on the unpaid amount of the invoice. Indemnities will be set based on specific tiers of outstanding billed amounts. Additionally, late payment interest will be capped according to the rate set by the law for commercial transactions.
These new rules will also apply to lawyers, collection agencies, and bailiffs if their services are solicited to recover overdue payments.
