Registration of Residential Leases (Brussels Region)

In accordance with the Ordinance of April 25, 2024, amending the Brussels Housing Code to organize the regional registration of residential leases, every lease concerning a dwelling must be registered within two months of its signing. This registration is not subject to any registration fee; it is free and the responsibility of the lessor.

As of January 1, 2025, residential leases concerning dwellings located in the Brussels-Capital Region must be registered on a new online platform of the Brussels Region. Alternatively, leases can also be registered via a downloadable paper form to be submitted by mail.

The registration is recommended for the following reasons:

  • Legal Obligation: It is a mandatory legal requirement.
  • Indexation and Notice Periods: This registration is a necessary and mandatory condition to index the rental amounts and benefit from the notice periods provided in the Brussels Housing Code.
  • Legal Security: This registration provides better legal security for both the lessor and the tenant. Note that in this case, the lessor’s privilege is tied to the registration formality.
  • Lessor’s Privilege: The lessor has a privilege over the movable property in the rented premises owned by the tenant or third parties, for unpaid rents and charges, repair of rental damages, and any other sums due under the lease (e.g., early termination compensation). This privilege also extends to any compensation owed to the tenant for the loss or destruction of these movable items, such as insurance compensation.

The contracts concerned are all residential leases in Brussels signed:

  • From 01/01/2025.
  • Before 01/01/2025, but which have not yet been registered on the federal platform of the FPS Finance (MyRent).

Note that leases not related to a dwelling (commercial properties, offices, warehouses, garages, etc.) must still be registered solely on the FPS Finance online platform. Student leases, sliding leases, and shared housing leases are considered residential leases.

Additionally, to fulfill the registration formalities, residential leases must include certain legal details, and specific documents must be provided as attachments, such as:

Information Required:

  • Full and detailed identification data of the lessor and tenant.
  • Precise data about the rented property (construction year, floor, area, number of rooms and description, thermal insulation, etc.).
  • Information about certain specific equipment.
  • Description of the type of heating.
  • Data regarding energy meters.
  • Communication of information on the energy performance of the building.
  • Charges (type, conditions, etc.).

Required Documents:

  • PEB certificate.
  • Inventory.
  • Photos.
  • Etc.

It is also possible to have a lease registered by a third party.

The FPS Finance has confirmed that the obligation to register residential leases on the federal MyRent platform remains in place.

Currently, it is advisable to register the lease twice: once on the federal platform and once on the regional platform.

This inconsistency is expected to be resolved during 2025.
