If one of your employees falls ill during their vacation in 2023, the sick days will not be counted as such and will remain vacation days, following the current legislation. Therefore, there is no need for a medical certificate for these days.
However, starting from the vacations in 2024, the legislation will change, and sick days during vacations will be considered as paid sick days. In this case, a medical certificate will be necessary to receive the guaranteed salary.
It is important to note that this change in legislation will only apply to vacations taken from 2024 onwards and not those taken in 2023.
